🔒Health and Safety Compliance

Legal Basis:

  • Health and Safety at Work etc. Act 1974
  • The Management of Health and Safety at Work Regulations 1999
  • The Housing Health and Safety Rating System (HHSRS) under the Housing Act 2004

Duties:

  • Conduct regular risk assessments for communal areas
  • Ensure fire safety, proper lighting, and clear access routes
  • Maintain trip/slip hazard control (e.g., wet floors, loose paving)
  • Ensure asbestos management if applicable (see below)

 

🔥 2. Fire Safety

Legal Basis:

  • Regulatory Reform (Fire Safety) Order 2005
  • Fire Safety Act 2021 (post-Grenfell reforms)

Duties:

  • Carry out a Fire Risk Assessment of communal areas
  • Maintain fire doors, alarms, emergency lighting, and signage
  • Keep communal escape routes clear and functional
  • Appoint a “Responsible Person” (within the apartments)

 

🌿 3. Maintenance & Cleaning Standards

Legal Basis:

  • Landlord and Tenant Act 1985
  • Commonhold and Leasehold Reform Act 2002
  • Lease agreements

Duties:

  • Keep communal areas clean, safe, and in good decorative order
  • Maintain lighting, flooring, gardens, windows, etc.
  • Respond to repairs promptly and document works undertaken
  • Ensure contractors are insured, competent, and approved

 

📜 4. Lease Obligations and Service Charges

Legal Basis:

  • Landlord and Tenant Act 1985 & 1987
  • Commonhold and Leasehold Reform Act 2002
  • Leasehold and Freehold Reform Act 2024 - only partly implemented

Duties:

  • Comply with the terms of the lease, which may set out the scope of communal maintenance
  • Properly account for service charges (reasonable, transparent, and based on actual costs)
  • Conduct consultation for major works (Section 20 consultation process)

 

⚠️ 5. Waste Management

Legal Basis:

  • Environmental Protection Act 1990

Duties:

  • Ensure safe and sanitary storage and disposal of waste
  • Provide adequate bins and recycling facilities
  • Prevent fly-tipping or misuse of communal waste areas

 

📊 6. Reporting and Documentation

Duties:

  • Keep records of inspections, repairs, contractor certifications, and complaints
  • Ensure data protection when handling tenant or leaseholder details (GDPR compliance)
  • Be transparent with residents about costs and works

 

🔍 7. Other Relevant Standards

  • Anti-Money Laundering (AML) - we are not responsible for any tenants and residents have already gone through the process purchasing their homes.
  • Know our Customer - we will be vigilant about residents.
  • Electrical Safety Regulations - for communal systems and emergency lighting.
  • Equality Act 2010 - communal areas must be accessible where required.
  • Leasehold Reform Act 2024 (LFRA2024) - we are also taking note of and keeping an eye on the Leasehold and Freehold Reform Act 2024 which is now law although far from being fully implemented.
